Prenuptial Agreements and the Law
Washington State law has recognized prenuptial and post-nuptial agreements. The future spouse must have adequate time before the marriage to review a proposed prenuptial agreement. The document must clearly identify the separate assets. The agreement cannot be the result of coercion, force, or misrepresentation. In addition, the parties to the agreement must live by the terms of the agreement throughout the marriage.
