Bellevue Interstate Custody Attorney
The world is now more "global" than ever. Companies transcend boundaries, global trade and tourist travel are very common, and so are marriages and families. With this evolution have come legal issues around the custody of children. When parents separate or divorce and live in separate countries, various laws apply.
We serve clients attempting to regain custody from the other parent in another state or country, or parents with whom the child is physically present. They may be in this country and have a custody dispute with the other parent in a foreign country, or in a foreign country when the other parent is here in the United States.
In the U.S., the UCCJEA (Uniform Child Custody Jurisdiction and Enforcement Act) applies, in nearly every state. It determines which state will have jurisdiction to make or modify custody and requires that states enforce each other's determinations.
The Hague Convention on the Civil Aspects of International Child Abduction (The Hague Convention) is a treaty designed to return children to their home country ("habitual residence") and to prevent a parent from trying to obtain an advantage by taking the children to another country where they think the law might be more favorable to them.
